📌 Data Controller

📄 Purpose of the Processing and Legal Basis

The Company will process your personal data in order to:

• allow users to navigate the website. The processing of personal data is based on the Controller’s legitimate interest, pursuant to Article 6(1)(f) of the GDPR, to ensure the proper functioning and security of the website;
• allow the registration and purchase of tickets for the To The Peak event and its official side events, scheduled to take place in Bolzano on the 10 september 2026 (hereinafter, the “To The Peak Event”). The processing of your personal data is based on the performance of a contract, pursuant to Article 6(1)(b) of the GDPR. For these purposes, personal data may be transferred to Bemils S.r.l., the company responsible for providing ticketing services;
• join the To The Peak network through the use of the matching tool “Knock,” developed by MetaEsse S.r.l. By accepting the terms and conditions, you authorize: (i) the Controller to send communications related to the use of the matching tool, including surveys, and (ii) MetaEsse S.r.l., as data processor, to create an account on your behalf in order to enable full access to the tool’s functionalities. See: https://flashbeing.com/terms/ As part of this processing activity, the Controller may transfer your personal data to event sponsors, as detailed in the “Recipients of Personal Data” section of this Privacy Policy. The legal basis for this processing is your consent, pursuant to Article 6(1)(a) of the GDPR. Providing consent is optional; however, without it, you will not be able to join the To The Peak network;
• receive commercial communications regarding program and related updates, both before and after the To The Peak Event. These may include partner promotions, discounts, and information about future editions. As part of this processing activity, the Controller may transfer your personal data to event sponsors, as outlined in the “Recipients of Personal Data” section of this Privacy Policy. The processing of your personal data is based on your consent, pursuant to Article 6(1)(a) of the GDPR. Providing consent is optional; however, without it, you will not receive commercial communications;
• if necessary, the Controller will process your personal data to establish, exercise, or defend a legal claim, whether in judicial, administrative, or extrajudicial proceedings, and/or to comply with legal obligations and requests from competent authorities. The processing of personal data is based on the legal bases set forth in Article 6(1)(c) and (f) of the GDPR.

🧾 Personal Data Processed

The Company will process the following personal data:

• IP number;
• Name, surname, email address, phone number, information related to your job and education and provided by you on the website.

👥 Categories of Data Subjects

The processing activities are directed towards the following categories of data subjects: website users; event participants (registered/ticket buyers); network/matching tool users; individuals interested in commercial communications.

⚙️ Processing Methods and Storage Period

The Controller will process your personal data through IT systems, with methods suitable to ensure their security and confidentiality in accordance with the GDPR. Your personal data will be processed for the period strictly necessary to achieve the purposes of the To The Peak Event and in accordance with the Controller's data retention policies.

With regard to the matching tool Knock, personal data will be retained for a period of 18 months following the conclusion of the To The Peak Event. After this period, the personal data will be deleted unless the user activates their account by the end of September 2026.

🛡️ Recipients of the Personal Data

The Controller may communicate your personal data to the following categories of subjects:

• authorized and duly trained personnel — including volunteers — of the Company, also regarding security measures and confidentiality obligations;
• third-party providers, appointed as data processors pursuant to Article 28 of the GDPR, may process your personal data in connection with services related to the event. These include, for example, Bemils S.r.l. for ticketing services and MetaEsse S.r.l. for the matching tool Knock services;
• network members operating on the matching tool Knock;
• where applicable, third-party subjects participating in the To The Peak Event as sponsors;
• where applicable, entities and authorities whose right to access personal data is expressly provided for by law or by measures issued by competent authorities.

💳 Payments

Ticket purchases for the To The Peak Event are processed through external payment service providers, which act as independent data controllers in relation to the processing of Personal Data.

In particular:

• during the payment process, users are redirected to platforms operated by payment providers (such as PayPal, Google Pay, or banking institutions);
• the website does not process or store any banking or payment instrument data (such as credit card numbers, security codes, or IBANs);
• payment providers collect and process the necessary data in accordance with their own privacy policies, which users are encouraged to consult at the time of the transaction.

🌍 Data Transfer Outside the European Union

The Controller will process your personal data within the European Union.

⚖️ Data Subject Rights

The data subject may exercise, where applicable, the rights set out in Articles 7(3) and 15 to 22 of the GDPR, including by submitting the request directly to the Controller by using the following e-mail address: hello@tothepeak.com.

The Controller may request additional information necessary to verify the identity of the data subject before processing the request.
